PLACING YOUR ORDER

When you make a purchase from this website, you are indicating that you agree to be bound by these Terms and Conditions, so please read them carefully and retain a copy for your records.

We may revise these Terms and Conditions from time to time. Any changes will apply to future orders placed after the updated Terms and Conditions are published on our website. Your statutory rights are not affected.

A contract does not exist between The Present Shop (Kirkcaldy) Ltd and the customer until the goods are dispatched. We reserve the right, at our discretion, to refuse any order.

Products remain the property of The Present Shop (Kirkcaldy) Ltd until payment has been made in full. Products will not be reserved for a customer until payment has been received in full unless otherwise agreed.

All prices shown include VAT where applicable. The Present Shop (Kirkcaldy) Ltd reserves the right to change prices at any time. All goods are subject to availability. If we are unable to supply the goods ordered, we will refund any money already paid.

The price for the goods will be the price displayed at the time the order is placed. We reserve the right to correct pricing errors or omissions. If a pricing error affects your order, we will inform you of the correct price and give you the option to proceed or cancel the order.

Prices shown on the website may differ from those displayed in our retail stores.

Payment online may be made by Visa, MasterCard, Visa Debit, Maestro or PayPal. Please contact us at sales@thepresentshop.co.uk if you wish to use an alternative payment method such as BACS, Postal Order or Cheque. Goods cannot be dispatched or allocated to an order until cleared payment has been received.

SUITABILITY OF GOODS

We take reasonable care to ensure that product descriptions and images are accurate. However, due to continuing product development, supplier changes or manufacturing variations, product specifications, packaging or designs may vary without notice.

Due to differences in internet browsers, devices and monitor settings, colours displayed on screen may differ slightly from the actual product.

If you receive goods that are damaged, defective, incorrect, not as described, or otherwise do not conform to the contract, please contact us as soon as possible. Nothing in these Terms and Conditions affects your statutory rights under the Consumer Rights Act 2015. Where applicable, you may be entitled to a repair, replacement, refund or other remedy in accordance with your legal rights.

CONSUMER RIGHT TO CANCEL

If you are purchasing goods as a consumer, you have the right to cancel your order within 14 days without giving any reason under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

The cancellation period expires 14 days after the day on which you, or a third party nominated by you (other than the carrier), takes physical possession of the goods.

To exercise your right to cancel, you must inform us of your decision by a clear statement. You may do this by email, post, telephone, or by using the "Withdraw from Contract" button available in the footer of our website.

Use of the "Withdraw from Contract" button constitutes a valid exercise of your statutory right to cancel within the applicable cancellation period.

If you cancel your order within the statutory cancellation period, we will reimburse all payments received from you, including the cost of standard delivery (where applicable), without undue delay and no later than 14 days after we receive the returned goods or evidence that they have been returned.

Nothing in these Terms and Conditions affects your statutory rights.
